Terms of Use

These Terms of Use ("Terms") govern your use of the Cadence application ("Cadence", "the App"), published by Paul Badarau, trading as alplustech ("we", "us", "the developer"). By downloading, installing, or using Cadence, you agree to these Terms.

Medical disclaimer: Cadence is not a medical device and does not provide medical advice, diagnosis, or treatment recommendations of any kind. It never calculates, recommends, or adjusts a medication dose. It only records the doses, weights, meals, and side effects you enter yourself and reminds you of the schedule you configured. Always make decisions about your health and medication, including GLP-1 dosing and titration, together with a qualified healthcare professional. If you believe you are experiencing a medical emergency, contact emergency services immediately.

1. License

Cadence is licensed, not sold, to you for personal, non-commercial use in tracking your own GLP-1 treatment. You may use Cadence on devices associated with your Apple ID in accordance with Apple's sharing rules.

2. Subscriptions and purchases

Cadence offers optional auto-renewing subscriptions and a one-time purchase ("Cadence Plus"). Payment is charged to your Apple ID at confirmation of purchase. Auto-renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel a subscription in your App Store account settings. All billing is handled by Apple; for refunds use Apple's reportaproblem.apple.com.

3. Apple's Licensed Application End User License Agreement

Your use of Cadence is also subject to Apple's standard Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms are silent or where Apple's EULA imposes stricter obligations, Apple's standard EULA governs; where these Terms are more specific to Cadence (such as the medical disclaimer and data terms), these Terms apply in addition to, and not instead of, Apple's EULA.

5. Your data

All information you enter is stored on your device and, if you enable iCloud, in your own private iCloud account, as described in our Privacy Policy. You are responsible for the accuracy of the information you enter and for maintaining access to your own Apple ID and iCloud account.

6. No warranty

Cadence is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of defects, or that logged data, reminders, or exports will always be accurate or delivered on time.

7. Limitation of liability

To the maximum extent permitted by applicable law, in no event will the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or health outcomes, arising out of or related to your use of, or inability to use, Cadence, even if advised of the possibility of such damages. Where liability cannot be excluded under Romanian or EU consumer protection law, our liability is limited to the amount you paid for the App in the twelve months preceding the claim.

8. Termination

You may stop using Cadence and delete it at any time. We may update or discontinue features of the App from time to time; where required by applicable law or the App Store, we will provide reasonable notice of material changes.

9. Governing law

These Terms are governed by the laws of Romania and, where applicable, the European Union, without regard to conflict-of-law principles. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the competent courts of Romania, except where mandatory consumer-protection law provides otherwise.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where required, note the change in the app's release notes.
